1. Agreement Acknowledgment

By accessing, browsing, or using the EatYummy platform — including our website and mobile applications for iPhone, iPad, and Android devices — you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease using the platform.

The EatYummy platform is owned and operated by Insta Soft LLC, operating under the commercial name "EatYummy". These Terms and Conditions, together with our Privacy Policy, Refund Policy, and Delivery Policy, constitute a legally binding agreement between you (the "User") and Insta Soft LLC (the "Company," "we," "us," or "our").

By creating an account or placing an order through the platform, you confirm that you have the legal capacity to enter into this agreement and that you accept all terms herein without reservation or modification.

2. Description of Services

EatYummy provides an online platform that enables users to browse, select, and order food, beverages, groceries, and other products from partner restaurants, bakeries, beverage providers, grocery stores, and other merchants (collectively referred to as "Merchants").

Important clarifications regarding our services:

• Intermediary Role: EatYummy acts solely as an intermediary marketplace that connects users with Merchants.
• Merchant Responsibility: Each Merchant is independently responsible for the quality, safety, preparation, packaging, and accuracy of the products it offers.
• No Verification Guarantee: While EatYummy takes reasonable steps to partner with reputable Merchants, we do not independently verify any Merchant's credentials, licenses, certifications, product quality, ingredient lists, nutritional information, or allergen disclosures.
• Dietary & Allergen Information: Users with dietary restrictions or food allergies are strongly advised to contact the Merchant directly before placing an order.
• Product Availability: Product listings, prices, and availability are determined by each Merchant and may change at any time without prior notice.

3. Account Creation & User Responsibilities

3.1 Account Registration

To access certain features of the platform, you may be required to create a user account. During registration, you must provide accurate, current, and complete information.

3.2 Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to:

• Keep your password secure and not share it with any third party
• Immediately notify EatYummy if you suspect any unauthorized access to your account
• Accept full responsibility for all activities that occur under your account

3.3 Data Sharing with Merchants

By placing an order, you consent to EatYummy sharing limited personal information with the relevant Merchant and delivery partner as necessary to fulfill your order. Please refer to our Privacy Policy for full details.

3.4 Single Account Policy

Each individual is permitted to maintain only one (1) active account on the platform. Creating multiple accounts is strictly prohibited.

3.5 Prohibited Uses

When using the platform, you agree that you will not:

• Upload any content that is unlawful, harmful, threatening, abusive, defamatory, or objectionable
• Use the platform to distribute spam, chain letters, or pyramid schemes
• Impersonate any person or entity
• Interfere with or disrupt the experience of other users
• Attempt to gain unauthorized access to any part of the platform
• Use automated tools, bots, or scrapers without our prior written consent
• Use the platform for any illegal purpose

4. How Orders Work

4.1 Placing an Order

To place an order, you must:

1. Browse available Merchants and their product listings
2. Select the products and add them to your cart
3. Review your order details carefully
4. Confirm your order and proceed to payment

4.2 Order Confirmation

Once you submit your order, it is sent to the relevant Merchant for acceptance. The order is confirmed only when the Merchant accepts it.

4.3 Order Accuracy

Important: You are responsible for reviewing all order details before submission. Once submitted, errors generally cannot be corrected.

5. Order Cancellation

5.1 Cancellation Before Merchant Acceptance

If you cancel before the Merchant has accepted, you are entitled to a full refund.

5.2 Cancellation After Merchant Acceptance

Once the Merchant has accepted your order and begun preparation, cancellation may not be possible. A partial refund or no refund may apply.

5.3 Cancellation by EatYummy or Merchant

EatYummy or the Merchant may cancel an order at any time due to product unavailability, pricing errors, suspected fraud, or other legitimate reasons. A full refund will be issued.

6. Delivery

6.1 Delivery Areas

Products and Merchants available may vary depending on your delivery location.

6.2 Delivery Times

Estimated delivery times are approximate and not guaranteed. Actual times may be affected by traffic, weather, order volume, and delivery partner availability.

6.3 Presence at Delivery

You must be present and available at the specified delivery address to receive your order.

6.4 Failed Deliveries

A delivery is considered failed if you are not present, unreachable, or the address is inaccessible. The platform reserves the right to cancel without refund.

6.5 Non-Cancellation Due to Unreachability

If the delivery partner is unable to reach you for 3 to 5 minutes, the order may be cancelled without refund.

6.6 Wrong, Missing, or Defective Orders

Contact our support team immediately with a description and photo evidence. Appropriate compensation will be provided at EatYummy's discretion.

6.7 Late Delivery

Compensation for late deliveries will be provided at EatYummy's sole discretion.

6.8 Contactless Delivery

If you select contactless delivery, EatYummy shall not be responsible for any theft, loss, or damage after placement at the designated location.

7. User Responsibilities

7.1 Accuracy of Information

You are responsible for ensuring all information you provide is accurate, complete, and up to date.

7.2 Content & Conduct

Any content you submit is considered non-confidential. You grant EatYummy a worldwide, royalty-free license to use such content.

7.3 Safe Use of the Platform

You shall not attempt to hack, reverse-engineer, or introduce malicious code to the platform.

7.4 Indemnification

You agree to indemnify and hold harmless EatYummy from any claims arising from your use of the platform or violation of these Terms.

7.5 Payment Terms

You agree to pay for all orders including product prices, delivery fees, service charges, and applicable taxes.

7.6 Minors

Users under 18 may use the platform only with parental consent and supervision.

8. Acceptable Use & Prohibited Activities

The platform is provided exclusively for ordering food and products. Any other use is prohibited, including illegal activities, financial crimes, and unacceptable behavior toward Merchants, delivery partners, or staff.

9. Platform Rights

EatYummy reserves the right to suspend, modify, or discontinue services, cancel orders, manage accounts, and protect its intellectual property at any time.

10. Validity of Platform Records

Electronic records maintained by EatYummy's systems constitute binding evidence in the event of any dispute.

11. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Arab Republic of Egypt. Disputes shall be subject to the exclusive jurisdiction of the Cairo Court of First Instance.

12. Severability

If any provision is found invalid, the remaining provisions shall continue in full force and effect.

13. Amendment of Terms

EatYummy reserves the right to amend these Terms at any time. Continued use constitutes acceptance of the updated Terms.
